Acceptance of Terms

By accessing and using CureBytes' medical billing and revenue cycle management services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms & Conditions constitute a legally binding agreement between you (the "Client" or "Practice") and CureBytes LLC ("CureBytes," "we," "us," or "our").

Services Description

CureBytes provides comprehensive medical billing and revenue cycle management services, including but not limited to:

  • Medical billing and claims processing
  • Revenue cycle management and optimization
  • Provider credentialing services
  • Patient registration and scheduling support
  • Medical coding and audit services
  • Accounts receivable follow-up
  • Practice management consulting
  • Reporting and analytics

Specific services provided will be outlined in your Service Agreement, which forms part of these Terms & Conditions.

Client Responsibilities

As a client of CureBytes, you agree to:

  • Provide accurate, complete, and timely information necessary for service delivery
  • Maintain current professional licenses and certifications
  • Comply with all applicable healthcare laws and regulations
  • Provide secure access to necessary systems and data
  • Review and approve all claims before submission (if required)
  • Pay all fees according to the agreed payment schedule
  • Notify CureBytes promptly of any changes affecting service delivery
  • Maintain appropriate professional liability insurance
Payment Terms

Fees and Billing

  • Service fees are calculated as specified in your Service Agreement
  • Fees are typically based on a percentage of collections or flat monthly rates
  • Additional services may incur separate charges
  • All fees are exclusive of applicable taxes

Payment Schedule

  • Fees are deducted from collections before remittance to client
  • Monthly statements provided detailing all transactions
  • Late payment charges may apply for overdue amounts
  • Client responsible for any collection costs or legal fees
Confidentiality & HIPAA Compliance

CureBytes is committed to maintaining the confidentiality and security of all client and patient information in accordance with HIPAA regulations and other applicable privacy laws.

  • A Business Associate Agreement (BAA) governs the handling of Protected Health Information (PHI)
  • All staff undergo HIPAA training and sign confidentiality agreements
  • Technical, physical, and administrative safeguards protect all data
  • Breach notification procedures are in place as required by law
  • Client data is never shared with unauthorized third parties
Limitation of Liability

CureBytes' liability is limited to the extent permitted by law. Specifically:

  • Total liability shall not exceed the fees paid by client in the 12 months preceding the claim
  • CureBytes is not liable for indirect, consequential, or punitive damages
  • Client acknowledges that billing outcomes depend on multiple factors beyond CureBytes' control
  • CureBytes maintains professional liability insurance
  • Claims must be brought within one year of the incident

This limitation does not apply to damages resulting from gross negligence or willful misconduct.

Termination

Termination by Client

  • 30-day written notice required for termination
  • Client responsible for all fees accrued through termination date
  • CureBytes will assist with transition to new billing provider

Termination by CureBytes

  • 30-day notice for termination without cause
  • Immediate termination for breach of contract or non-payment
  • Immediate termination for illegal activities or license suspension

Post-Termination

  • CureBytes will complete processing of pending claims
  • Final accounting and remittance within 30 days
  • Client data returned or securely destroyed as requested
  • Confidentiality obligations survive termination
Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of the State of [State], without regard to conflict of law principles.

Any disputes arising from these terms or the services provided shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation if negotiation fails
  3. Binding arbitration as a last resort

The prevailing party in any dispute shall be entitled to reasonable attorney's fees and costs.
